Citgo is appealing a federal district court decision that it should pay $81 million in Clean Water Act (CWA) civil penalties because it was “grossly negligent” of deficiencies at a Lake Charles, LA, refinery that led to a 2006 oil spill -- setting up a new appellate test of the standard courts should use to determine negligence in calculating CWA penalties.
