A federal appellate court has upheld a lower court ruling requiring the Biden administration to subject a portion of the Dakota Access Pipeline (DAPL), a major fossil energy project, to a stringent environmental review under the National Environmental Policy Act (NEPA), affirming a precedent subjecting “highly controversial” projects to such reviews.
