Terms and Conditions

The InsideEPA online news service (the "Site") is operated and maintained by Inside Washington Publishers. Any use of the Site is subject to these terms and conditions, and any use of the Site shall act as the user's agreement to abide by these terms and conditions.

License Grant

Access to InsideEPA is pursuant to a subscription, which, unless specified otherwise in posted pricing policies, grants to a single user authorization to access the Site. Site licenses granting multi-user access toInsideEPA are available and are subject to written agreement between Inside Washington Publishers and the subscriber. Access to all portions of the Site except the home page is permitted only to current paid subscribers, except as authorized (in, for example, the case of trials) by Inside Washington Publishers. All others are prohibited from accessing the subscriber-only portions of the Site. A single copy of information displayed on the Site may be downloaded and viewed and/or printed solely by permitted users for non-commercial personal use only, provided all copyright and other proprietary notices contained on the materials are retained. No other rights in and to the material on the Site are granted to subscribers. Users may establish, through hypertext or other computer links, a link to the non-subscriber accessible portion of the Site. Disclosing sufficient information to any non-subscriber to allow that non-subscriber to deep link to the subscriber-only portions of the Site, is expressly prohibited and a violation of Inside Washington Publishers' proprietary rights in the material accessible therein. Providing non-subscribers a password enabling access to the subscriber-only accessible portion of the Site is expressly prohibited and a violation of Inside Washington Publishers'proprietary rights in the information accessible therein.

Ownership of Materials

The Site contains material which is copyrighted and may not be reproduced without the express written permission of Inside Washington Publishers, except as expressly provided herein. Reproduction, republishing, displaying, performing, distributing, modifying, transmitting, reusing, re-posting, or using the copyrighted content of the Site for public or commercial purposes, including, without limitation, the text, images, audio and/or video, without the express written permission of Inside Washington Publishers, is prohibited.

Trademarks

Any trademarks and service marks (collectively the "Trademarks") displayed on the Site are Trademarks ofInside Washington Publishers or the respective owner of the Trademarks. INSIDE EPA WEEKLY REPORT, INSIDE Cal/EPA, WATER POLICY REPORT, SUPERFUND REPORT, CLEAN AIR REPORT, ENVIRONMENTAL POLICY ALERT, RISK POLICY REPORT, INSIDE WASHINGTON PUBLISHERS and IWP are Trademarks ofInside Washington Publishers. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of Inside Washington Publishers or of the owner of the Trademark. Use of the Trademarks displayed on the Site without written permission, or any other content on the Site, is strictly prohibited.

Access to Portions of Site

Inside Washington Publishers reserves the right to terminate access to the subscriber-only accessible portion of the Site at will. As a result of any such termination, the terminated subscriber shall have as his only recourse a refund of the unused subscription price. Inside Washington Publishers reserves, and does not waive, its right to enforce its proprietary rights against any such terminated subscriber, and shall have the right to offset any unused subscription against any damages incurred by Inside Washington Publishers from the terminated subscriber's actions.

Representations

Inside Washington Publishers has provided its subscribers accurate, reliable and timely information for more than three decades. Aside from its commitment to accuracy, Inside Washington Publishers shall not be responsible for any damages stemming from the use or inability to use information on the Site, and in any case shall not be responsible for consequential damages or lost profits. Inside Washington Publishers is not responsible for the content of linked sites, makes no representations about the accuracy of such content, and disclaims any liability as to the content of any linked sites, which links are provided solely as a convenience and do not constitute an endorsement of the contents of the linked sites. Inside Washington Publishers assumes no responsibility, and shall not be liable, for any damage to, or viruses that may infect, computer equipment or other property stemming from access to, use of, or browsing in the Site or from downloading of any materials, data, text, images, video, or audio from the Site.

General

This agreement, and any other agreements (together the "Agreement"), constitutes the entire understanding between the parties hereto with respect to the subject matter hereof. In the event any provision of this Agreement conflicts with any provisions of any other agreement between the parties hereto, the provisions of this Agreement shall control. This Agreement shall not be modified or amended except by way of writing and then only when signed by duly authorized representative of the party against whom enforcement thereof is sought. This Agreement shall inure to the benefit of and be binding upon the respective successors, heirs and assigns of the parties hereto. In the event of the user's unauthorized use of the content of the Site, IWP shall not have an adequate remedy at law, and thus, in addition to all other available remedies, IWP shall be entitled to immediate injunctive relief, associated costs and attorneys fees. This Agreement shall be governed by, construed under and enforced in accordance with the laws of the United States of America and the Commonwealth of Virginia, without regard to such jurisdiction's conflicts of laws principles. The content of the Site shall be deemed to be provided in the Commonwealth of Virginia.
