Environmentalists urge district court to maintain suit over utility ELG

The Center for Biological Diversity (CBD) is asking a federal district court to preserve its suit over EPA’s delay of the 2015 Clean Water Act (CWA) power plant effluent rule, saying industry groups’ bid to dismiss the case is based on “policy arguments” rather than the water law’s “plain language” on which courts can review federal rulemakings.
