Judge finds Title V air permit suits not subject to statute of limitations

A Colorado federal district court judge has rejected a coal mining company’s effort to dismiss environmental groups’ lawsuit against it alleging Clean Air Act permit violations, finding that litigation over such claims for Title V operating permits is not subject to the general five-year statute of limitations.
