The steel industry is seeking en banc rehearing of an appeals court decision denying its request to stay EPA’s tougher air toxics rule for integrated steel manufacturing, claiming that recent high court precedent ending deference to agencies’ interpretation of ambiguous statutory terms requires rehearing of the divided panel’s decision.
