9th Circuit Grants EPA Remand Request For Dust-Lead Clearance Levels

A federal appeals court has granted EPA’s request to voluntarily remand back to the agency, without vacatur, its dust-lead clearance levels, but has rejected environmentalists’ push for the court to also retain jurisdiction and require status reports on the rulemaking.
