9th Circuit Muddies Landscape On When CERCLA 113 Claims Are Viable

The U.S. Court of Appeals for the 9th Circuit, in a ruling of first impression, is adding to a circuit split on when potentially responsible parties may seek contribution claims under the Superfund law while also creating its own definition of when a potentially responsible party (PRP) resolves its liability that “falls in the middle” of other court's definitions.
