9th Circuit Scraps Ruling That Broadened RCRA ‘Transporter’ Liability

A federal appeals court has scrapped a contentious ruling that parties could be liable as Resource Conservation & Recovery Act (RCRA) “transporters” for inadvertently moving discarded chemicals from one point to another even if they played no role in the original disposal, backing utilities and others who said that precedent would radically expand RCRA’s reach.
