9th Circuit Weighs FY93 Law's Bar On Corps' CWA Wetlands Handbook

An Alaska land-holding firm is urging the U.S. Court of Appeals for the 9th Circuit to bar the Army Corps of Engineers from applying its decades-old “regional supplements” to a 1987 handbook to assess when a property contains wetlands subject to the Clean Water Act (CWA), arguing that a district judge was wrong to allow the manual's use.
