EPA’s Environmental Appeals Board (EAB) is denying a challenge brought by a Utah tribe to Region 8’s Clean Air Act (CAA) permit for Deseret energy’s Bonanza power plant, agreeing with EPA that the agency was not required to address the tribe’s environmental justice (EJ) concerns because such policies are not currently enforceable.
