D.C. Circuit Revises DSW Opinion, Grants Industry Bid For Rule Exclusion

A federal appeals court panel is revising its ruling that vacated aspects of an Obama-era definition of solid waste (DSW) rule, granting industry's request to exclude petroleum refinery catalysts from strict hazardous waste regulation for third-party recyclers and to scrap a test for determining the legitimacy of hazardous materials recycling.
