Environmentalists Cite Congress’ NEPA Reforms In Bid To Boost OB/OD Suit

Environmentalists are charging that Congress’ recent amendments to the National Environmental Policy Act (NEPA) narrows the circumstances that exempt agencies from reviewing the environmental impacts of their decisions, rejecting Air Force’s defense in pending litigation that federal waste law serves as a “functional equivalent” that exempts its open burning/open detonation (OB/OD) operations from such review.
