EPA is continuing to press appellate courts to transfer lawsuits over its disapproval of states’ interstate ozone plans to the U.S. Court of Appeals for the District of Columbia Circuit, citing a recent ruling from the 6th Circuit transferring Kentucky’s case against the related Good Neighbor Plan (GNP) rule to the D.C.-based court.
