EPA’s top civil enforcement official says the use of supplemental environmental projects (SEPs) in enforcement settlements are picking up “bit by bit” after the Department of Justice (DOJ) last May revoked an internal Trump-era rule that enshrined the prior administration’s ban on SEPs.
