EPA is urging a federal appeals court to reject a Michigan road commission's suit challenging the agency's objection to a proposed state-issued Clean Water Act (CWA) permit for a new road, saying the commission is wrong to claim that a Supreme Court ruling allowing judicial review of CWA jurisdiction findings extends to permit objections.
