High Court Urged To Resolve Split On EPA's Application Of Legal Rulings

A wastewater group is urging the Supreme Court to resolve what it says are judges' divergent views on whether EPA decisions to not apply an adverse appellate court ruling in other circuits qualifies as a change in rulemaking subject to challenge in circuit court, or a non-rulemaking that creates a lengthier and more complicated path for litigation.
