In Industry Win, Panel Sends Methylene Chloride Rule Suits To 5th Circuit

In a win for industry groups, a federal judicial panel has selected the U.S. Court of Appeals for the 5th Circuit to hear consolidated litigation over EPA’s precedent-setting rule governing methylene chloride -- the second time the conservative court has won jurisdiction over a TSCA rule after it was assigned litigation over the chrysotile asbestos rule in May.
