Judges Grapple With Ex-EPA Advisers’ Standing To Challenge CASAC Picks

Judges on the U.S. Court of Appeals for the District of Columbia Circuit have ordered additional briefing on whether former EPA science advisers have standing to bring their case seeking to dismiss the agency’s Clean Air Scientific Advisory Committee (CASAC) as unlawfully constituted, after expressing doubts at oral argument. In a short Sept. 12 per curiam order , the court on its own initiative directs parties to submit additional briefs within 10 days, “further addressing whether appellants have standing.”...
