With Kentucky Stay, 6th Circuit Deals A Blow To EPA Interstate Ozone Plans

The U.S. Court of Appeals for the 6th Circuit has granted an “administrative stay” temporarily abating EPA’s rule disapproving Kentucky’s plan to curb interstate ozone pollution, in a move that suggests EPA may be heading toward defeat in at least three judicial circuits on such a disapproval, with serious consequences for its interstate air policy.
