OMB Deems PFAS CERCLA Rule ‘Significant,’ Triggering Impact Analysis

In a win for industry, the Office of Management and Budget (OMB) has designated as “economically significant” EPA’s imminent proposal to list two per- and polyfluoroalkyl substances (PFAS) as Superfund “hazardous substances,” requiring the agency to issue a regulatory impact analysis (RIA) that includes a broader look at the landmark rule’s potential direct and indirect costs and benefits.
