Power Plant ELG Faces New Legal Challenge, Raising Venue Questions

A coalition of environmental groups is challenging EPA’s final effluent limitations guidelines (ELG) for coal-fired power plants, following a separate suit filed by another group in a different appellate circuit, raising questions over which court will hear the challenges. The coalition filed a May 30 petition for review of the final ELG rule to the U.S. Court of Appeals for the District of Columbia Circuit.
