States Urge EPA To Expand ‘Worst Case’ CWA Spill Rule Requirements

State officials are urging EPA to expand its proposed Clean Water Act (CWA) rule that would require facilities with above-ground chemical tanks to develop response plans for worst-case spills, with drinking water officials calling for provisions that would capture more facilities and emergency planning officials seeking greater cooperation from facilities. The proposed rule, which is subject to a July 26 comment deadline, is the result of a settlement agreement with environmentalists and would set first-time requirements for certain larger facilities...
