Supreme Court Stays EPA’s Good Neighbor Rule, Raises Bar For ALJs

The Supreme Court has blocked implementation of EPA’s Good Neighbor interstate ozone rule pending a ruling on the merits while also ruling in a separate case to raise the bar on when EPA and other agencies can have enforcement actions reviewed by administrative law judges (ALJs) rather than federal courts.
