Formal Publication Of CERCLA PFAS Rule Opens Door To Legal Challenges

EPA’s first-of-its-kind rule designating certain PFAS as “hazardous substances” under the Superfund law is scheduled to be published in the Federal Register May 8, starting a clock that will see the measure take effect 60 days from that date while giving industry and other parties 90 days to file legal challenges to the controversial rule.
