EPA Crafting 'Regional Consistency' Policy Exemption For Judicial Rulings

EPA is crafting an exemption to its “regional consistency” policy requiring uniform application of Clean Air Act requirements across all its regions that would exclude judicial rulings from the consistency policy, allowing EPA to limit the scope of adverse court decisions on its rules to only those states within the court's jurisdiction. Industry lawyers and environmentalists in response are highly critical of the planned rulemaking, which could result in some states being subject to one type of air law policy...
