EPA Says High Court Rulings Allow Permit Exemptions For Water Transfers

EPA and some states are touting Supreme Court rulings as giving the agency authority for its contested 2008 rule exempting some water transfers from Clean Water Act (CWA) permit mandates, saying the rulings allowing exemptions for transfers in one waterbody imply that EPA has discretion to allow exempt transfers between two separate waters. Environmentalists however are citing the high court decisions as bolstering their push for the U.S. Court of Appeals for the 2nd Circuit to vacate the water transfers...
