EPA urges D.C. Circuit to reject requests to pause ACE litigation

EPA is urging the U.S. Court of Appeals for the District of Columbia Circuit to reject environmentalist and state requests to pause litigation over the agency’s Affordable Clean Energy (ACE) coal plant climate rule until the agency finishes a related rule easing new source review (NSR) requirements and acts on administrative reconsideration petitions for ACE.
