Exxon urges 1st Circuit to continue stay of novel climate case

ExxonMobil is urging a federal appeals court to let stand a district court’s stay of novel Clean Water Act (CWA) climate change litigation, arguing first that the appellate court lacks jurisdiction to review the stay and then saying that if the court finds it has jurisdiction, it should affirm the lower court’s order.
