EPA Proposes First Time Denials On CCR ‘Part B’ Facility Demonstrations

EPA is proposing to deny requests from six coal-fired power plants in five states seeking exemptions from its rule requiring coal combustion residuals (CCR) to be disposed of in lined impoundments, the latest sign that the agency is strictly enforcing its rules as officials prepare to strengthen them. In a series of decisions announced Jan. 25, EPA proposed to find that the facilities’ “alternate liner demonstrations” failed to show compliance with the agency’s CCR regulations.
