EPA Renews Stormwater RDA Finding, Restarting Test Case On CWA Power

EPA has renewed its 2019 decision designating certain municipal stormwater systems in New Mexico for Clean Water Act (CWA) permitting, a move that will likely restart stalled litigation testing the agency’s rarely used residual designation authority (RDA) that allows officials to designate stormwater sources for permitting.
