A federal judge in North Dakota is granting a request from 24 state attorneys general for a preliminary injunction blocking implementation of the Biden administration’s rule revising the definition of “waters of the United States” (WOTUS) in their states, expanding to 26 the number of states where courts have blocked use of the rule and further undercutting EPA’s legal defenses.
