PENDING NSR RULE MAY GIVE INDUSTRY RELIEF FOLLOWING COURT RULING

The White House Office of Management & Budget (OMB) is reviewing a long-awaited EPA rule providing new flexibility for power generators and industrial facilities under the agency's new source review (NSR) program, after a federal appellate decision last month overturned a rule that would have provided broad NSR relief.
