Environmentalists are hoping to use their federal appeals court victory requiring EPA to strengthen its Obama-era coal ash disposal rule to bolster their calls for states to revise and strengthen their own ash permitting programs, saying federal waste law requires state programs to be “at least as protective as” a future reworked stricter EPA policy.
