EPA is firing back at environmentalists’ latest effort to advance their stalled litigation over EPA’s TSCA rule limiting use of the flame retardant decabromodiphenyl ether (decaBDE) by arguing environmental and tribal petitioners cannot cite a recent order from the U.S. Court of Appeals for the D.C.
